Environmental, Social, and Governance (ESG) litigation is on the rise in Argentina, particularly in relation to environmental, anti-corruption and human rights issues. Labour disputes are also very common, often based on the fact that labour law is part of public law and the rights granted to employees cannot be overridden by private contracts. ESG litigation is mostly initiated by NGOs. In most cases, ESG claims are brought against the Argentine state or ministries, but claims against individual private companies are also on the rise. The sectors most affected by ESG are extractive industries, agribusiness, petrochemicals and energy utilities. These sectors mainly involve large companies (local and multinational).
Argentina has signed and ratified the Escazú Convention, the first international treaty on the environment in Latin America and the Caribbean.
