Environmental, Social, and Governance (ESG) cases in Colombia often involve state institutions as defendants, because state institutions have a duty, or are perceived to have a duty, to monitor or mitigate climate change. Lawsuits are often brought by people allegedly harmed by climate change, such as indigenous peoples or minors, but also by non-governmental organizations (NGOs) and other specialised organisations. In several high-profile rulings, the Supreme Court has recognised the Amazon and Atrato Rivers as legal entities and granted them subjective rights to improve climate protection, particularly in these affected areas. The Supreme Court also ordered the government to develop plans to halt deforestation.
