Environmental, Social, and Governance (ESG) litigation is common in Ecuador. In Ecuador, nature has its own legal personality and enforceable rights. In addition, a landmark Supreme Court ruling responds to the specific challenges in a rainforest region by upholding the constitutional rights of the area against mining and extractive activities. Lawsuits are often brought by people allegedly harmed by climate change, such as indigenous peoples or minors, but also by non-governmental organizations (NGOs) or, for example, the International Federation of Human Rights. Thematically, the cases often concern the oil and gas sectors.
