Case Overview

The parties are in dispute over the authorship of song lyrics. The plaintiff, a songwriter, alleged that she independently wrote the song's lyrics without the use of AI. A producer subsequently used the AI tool SunoAI to generate music based on prompts, during which minor adjustments to the lyrics were made by the plaintiff and likely by SunoAI.

The producer released the song on a streaming platform. Another artist then created two versions of the song. The defendant, acting as the digital distributor under the other artist's label, released the two versions of the song across music streaming platforms.

The plaintiff claimed that the two versions contained substantial verbatim copies of her lyrics, asserting that the defendant's publication infringed her copyrights and filed for a preliminary injunction. 

The defendant however contested authorship, submitting an expert opinion that highlighted various inconsistencies and breaks in the lyrics, which were strong indications that the lyrics had been created using AI.
