October 2023	European Securities and Markets Authority (ESMA)

The European Securities and Markets Authority (ESMA) published a second consultation package under the Markets in Crypto Assets Regulation (MiCA).

ESMA is seeking input on five sets of proposed rules, covering:

sustainability indicators for distributed ledgers;
disclosures of inside information;
technical requirements for white papers;
trade transparency measures; and
record-keeping and business continuity requirements for cryptoasset service providers.

Deadline for comments is 14 December 2023.

ESMA will publish a final report on the basis of feedback received and submit the draft technical standards to the European Commission for endorsement by 30 June 2024 at the latest.

The European Securities and Markets Authority published its 2024 Annual Work Programme under which ESMA will ensure close market and risk monitoring and support the effective implementation of the European regulatory framework related to the digital and sustainability transitions.

ESMA published its second Trends, Risks and Vulnerabilities Report of 2021.

The Report highlights the continued rise in valuations across asset classes in an environment of economic recovery and low interest rates, the increased risk taking of investors and the materialisation of event risks.
