Whilst cryptoasset business models are continuing to challenge policy makers and regulators, it is important to acknowledge the application of existing legislation to the activities that are being conducted. Over the years, regulators such as the CFTC, OCC and SEC have brought enforcement action against cryptoasset entities and in doing so have highlighted the perimeter of existing legislation but also given guidance as to how they view certain products. As well as this guidance on how certain cryptoassets are classified in the eyes of regulators, there is also the expectation of increased enforcement action as regulators become more comfortable in the subject matter and bring in expertise.
