Entities designated by the National and Regional Environmental Plans, generally (but not exclusively) large companies and major polluters

The Law was enacted with the stated aims of: 

  • protecting and promoting environmental quality and public health through the prevention, reduction, and control of pollution;
  • assessing the environmental impact of proposed projects before their approval;
  • ensuring that natural resources are used rationally and sustainably;
  • encouraging the public to assist with the prevention of environmental harm(s); and
  • suppress any other forms of harm that might be done to the environment.

The Law includes provisions which provide for environmental impact assessments and pollution and waste control under the overall direction of the Ministry of the Environment (“MOE”). 

The MOE is empowered to monitor, regulate, and enforce against, activities that have the potential to cause environmental harm.  The MOE is mandated to propose more specific National and Regional Environmental Plans, which require approval from central government. 

All in scope entities and persons are required to adhere to the provisions of the legislations, and penalties for failures in this regard include significant fines, and up to five years in prison.
